All prices are displayed in South African Rand (ZAR) and include VAT where applicable.
Prices displayed at the time you place your order are the prices that apply to your order. We may update prices on the website at any time, but changes will not affect orders already placed and confirmed.
We reserve the right to modify or discontinue our services (or any part of them) at any time, provided this does not affect orders already placed.

§5 Products and Services

Some products are available exclusively online and may be limited in quantity.
Product images may vary slightly from the actual product depending on your screen and settings.
Product branding, packaging, and labelling may vary from the images shown on our website. This does not affect the product itself, its quality, or its intended use. For more information, please see our Return and Refund Policy.
We reserve the right to restrict the sale of our products to certain countries, regions, or persons.

Your rights under the Consumer Protection Act — including the implied warranty that goods are of good quality, match their description, and are reasonably suitable for the purposes for which they are generally intended (section 55) — are not affected by this clause.

§6 Orders, Billing, and Account Information

We may decline or cancel an order in limited circumstances — including suspected fraud, pricing errors, stock unavailability, incorrect information provided by the customer, or breach of these Terms. If we cancel a paid order, we will refund you in full.
We may limit or cancel quantities purchased per person, per household, or per order.
You agree to provide accurate, complete, and current information for all purchases. Incorrect or incomplete information may result in cancellation of your order.
If a shipment is returned to us due to an incorrect address you provided, or refusal to accept delivery, our Return and Refund Policy applies.

§7 Shipping and Delivery

Standard shipping: typically 11 to 21 business days from dispatch.
Express shipping: typically 8 to 13 business days from dispatch.

These are estimated delivery times based on our logistics partners' current performance. Actual delivery times may vary due to customs processing, courier delays, remote delivery locations, or other factors outside our reasonable control.

If your order has not arrived within a reasonable time of the estimated window, please contact us at info@amberaluna.com and we will investigate.

Your rights under the Consumer Protection Act and section 46 of the Electronic Communications and Transactions Act in respect of delivery are not affected by this clause.

§8 Cooling-Off Right (Electronic Transactions)

Under section 44 of the Electronic Communications and Transactions Act 25 of 2002, you have the right to cancel a purchase made through our website without reason and without penalty within 7 (seven) business days of receiving the goods. To exercise this right, please contact us at info@amberaluna.com before returning the goods.

The direct cost of returning the goods is your responsibility. We will refund the purchase price within 30 days of the cancellation.

This right does not apply to goods that are specifically excluded under section 42 of ECTA, including but not limited to:

Goods made to your specifications or personalised
Sealed goods that are not suitable for return due to health or hygiene reasons where the seal has been broken
Goods that by their nature cannot be returned or are liable to deteriorate rapidly

15.2 Limitation of liability (to the extent permitted by law)

To the maximum extent permitted by law, and subject to Section 15.1:

We do not warrant that the website will be uninterrupted, error-free, secure, or free from viruses or other harmful components.
We do not warrant that the results obtained from the use of our products will meet your expectations, particularly in relation to cosmetic outcomes, which vary between individuals.
We are not liable for any indirect, incidental, consequential, or special damages, including but not limited to loss of profits, loss of data, loss of goodwill, or loss of opportunity, arising out of or in connection with your use of the website or our products.
Our total aggregate liability to you for any claim arising out of or in connection with these Terms, the website, or any product purchased from us (other than under the Consumer Protection Act) is limited to the purchase price of the product giving rise to the claim.

15.3 Exclusions

To the maximum extent permitted by law, we are not liable for:

Any injury, loss, or damage caused by your misuse of a product, or use contrary to the instructions on the packaging.
Any allergic reaction or adverse effect where the ingredients or warnings were disclosed on the product or its packaging.
Any delay or failure to perform caused by events beyond our reasonable control, including natural disasters, pandemics, government action, courier failure, load-shedding, or customs delays.
Any loss arising from your failure to provide accurate delivery information or to accept delivery.

15.4 Product use

Our products are cosmetic and personal care items. Individual results may vary. You should use our products only in accordance with the instructions on the packaging. If you have known allergies or medical concerns, consult a medical professional before use.

§16 Indemnification

You agree to indemnify, defend, and hold harmless Prowl Digital Limited, its directors, employees, and partners from any third-party claims, damages, or expenses (including reasonable legal fees) arising from:

Your breach of these Terms
Your unlawful use of our website or products
Your violation of any third-party rights

This indemnification obligation is limited to the extent the claim or loss is caused by your conduct and does not apply where the claim arises from our own negligence, wilful misconduct, or breach of law.

§17 Chargebacks and Disputes

If you have a problem with your order, please contact us first at info@amberaluna.com. We will work with you in good faith to resolve the issue.

Your statutory rights, including your right to lodge a chargeback with your payment provider where legally available, and your right to refer a dispute to the National Consumer Commission or a Consumer Court, are not affected.

Please note: initiating a chargeback without first contacting us to attempt a resolution may result in additional processing costs and delays.

§18 Termination

These Terms remain in effect until terminated by either you or us.

You may terminate these Terms at any time by ceasing to use our services and, if applicable, closing your account by contacting info@amberaluna.com.
We may terminate or suspend your access to our services if you breach these Terms, with reasonable notice where practicable.

Termination does not affect any rights or obligations that have accrued prior to termination, or any provisions intended to survive termination (including Sections 15, 16, and 20).

§19 Entire Agreement

These Terms, together with our Privacy Policy and Return and Refund Policy, constitute the entire agreement between you and us and supersede any prior agreements, communications, or proposals relating to the same subject matter.

§20 Governing Law and Jurisdiction

These Terms are governed by the laws of the Republic of South Africa.

Any dispute arising out of or in connection with these Terms will be subject to the non-exclusive jurisdiction of the courts of the Republic of South Africa.

Nothing in this clause limits your rights under the Consumer Protection Act, the Electronic Communications and Transactions Act, or other applicable South African consumer protection laws, including your right to refer a matter to the National Consumer Commission, a Consumer Court, or an accredited ombud.

§21 Changes to These Terms

We may update these Terms from time to time. Material changes will be notified to you via email or a notice on our website. The current version is always available at amberaluna.com/policies/terms-of-service, with the "Last updated" date at the top of this document.

Changes will not apply retroactively to orders that have already been placed.
